Enervest has a permit (API34031259210100) to plug back a vertical well (API34031259210000) and drill a horizontal in the Clinton formation on a parcel in Coshocton county. The x and y axis as well as the latitude is different for the two permits. Are these considered to be the same well since the first 10 digits ODNR the permit numbers are the same?

Clinton wells were drilled early in Ohio , in 1897 there were 987 Clinton wells drilled to date 80,578 source ODNR . The Utica for the most part are wells that were drilled in when regulatory regulations where in place which makes one heck of a difference.What I was saying was in reference to fracking in a formation such as the Clinton where the fracking can migrate directly into a old well and non protected water tables.

Could they get the permit to HBP and just pretend they are maybe going to drill horizontal someday?
The vertical well was still producing both oil and gas in 2012.

Here at GOMS we have seen many ways mentioned on ways to hold leases from putting stakes in the ground, building a pad at the list minute and the list goes on.  I would think that any permit could be changed. For an example say a permit to drill into the Utica but while punching through the Clinton formation they get a show of oil. Well they keep drilling to the Utica get a core sample and say whippee , but funds are tight and we want more land around this hole or wait till we get more capital. They get a change in permit plug back to the Clinton and get a producing Clinton well, that ties up the lease. A lot depends upon the wording in the lease but most boiler plate leases allows for these games.

It looks like Milleson's belief of single formation leases may have been the route to follow.  200ft above and 200ft below, companies said no at 1st but had no choice as groups were formed.  I hear he is heading back into this region with his marketing team.  

Thanks for the clarification Utica "Therefore, we should not assume that all Horizontal Pipes are or will be fracked" My opinion was based upon the assumption that a horizontal is for the purpose of the production of a formation however test coring in a formation by horizontal can also be done. 

 My point was and still is if the Clinton was horizontally fracked that it could be a mess. Murphy's Law comes to play when least expected.

I noticed back in 2011 an "Existing Wells Excepted" clause was in some leases.

I expect that charges for plugging old wells will be deducted from royalties before any payments made on  those leases.

Rose run wells are moden wells drilled in 1990's so I would not worry about then  quit the fear mongering and do some research before you spout off the Clinton formation wells were drilled from the 1940's on and the spud date is not critical it is the plug date and the locations in coal bearing township are accurate.  this is from an oil drilling and producing family that goes back to the 1930's.

Those well pipe probably went to the mid - Michigan Dundee oil boom  of 1940. My father plugged some Ohio wells and took the pipe up there.
