Here is a solution to help the people that own the land without minerals rights which should be enacted. First if you own the land and the mineral rights your school, county and local real estate tax bill stays the same, but 50% of each bill is divided up between the mineral rights owner and the surface owner.
If you own the land without the mineral rights your real estate tax bill is now reduced by 50% and the other 50% being paid by the owner of the mineral rights of you surface land. This really would only cost the people that own the mineral rights, and why not they have the power to change the surface but have been getting off tax free.

Various attempts have been made to deal with elements of 'unfairness' perceived to exist within the Capitalist system.
Famous are the theories of Karl Marx as espoused in the various volumes of Das Kapital.
Marx's theories on 'how to make things more even' were expanded upon and widely instituted by Vladimir Lenin.
The last I checked, the attempts 'to make things more even' (also known as Socialism) had not worked out especially well.

I think the expression is that socialism works until you run out of other peoples' money to spend.
Other attempts to make capitalist system fair are patent law, copyright law, trademark law, criminal law, contract law, tort law, anti-trust law, those worked out pretty good, most US corporations believe.

I am not understanding what you mean by "landowner damages". If a well pad is placed on the surface owner's property, they are compensated for this. What other damages are you referring to?
Honestly if you own the surface rights and a well pad is placed on your property for the minerals underneath, you are compensated for what the driller feels is reasonable but I'm sure the surface owner feels differently. Most likely the compensation does even equal to the devalued land value if you ever sell. It would be hard to sell land with a well pad on it if you didn't even own the minerals rights.
This is from another topic about some 80+ year old people who do not own mineral rights yet are being " shafted" more or less by the increased traffic on their roads, noise, etc. Their quality of life has been damaged by those with mineral rights and leases. ( * Cannot wait until some enterprising attorney figures out a way to collect on this aspect).
