With the Rover pipeline and a few others going in, there are going to be low ball offers made to landowners because of the protection FERC offers to these companies. I've heard about the crazy offers. They are so low that they make you sick to your stomach. Plus, they want to pay you for the land in the ROW as acreage. For example, if the total length of the ROW is 1500 feet. They will figure it out in acreage and pay you for that. Your 1500 foot ROW might be two total acres. Two acres to them might be worth 4000 or 5000 thousand dollars. How do you feel about receiving that little amount for a 1500 feet ROW??? I've dealt with AEP (American Electric Power) before and they try to pull the same BS. When they have FERC / public utility their side, then they try to screw the landowner royally. Comments?

Many of us have received royalty and other gas related money, so hopefully landowners won't be swayed at the first low ball offer they receive. I intend to fight them. Give them a good fight.

Eminent domain, in my opinion, has become a bullying tactic to get what they want. It's a scare tactic in their bag of tricks to screw over the landowner.

The question is now one of FERC’s independence from the companies it works with and who fund it. Because if FERC does not deny this pipeline, it will show how FERC is a tool of the industry rather than a regulatory agency. While private enterprise is of course a good thing, seizing private land for private purpose, no matter how attractive it is to sell energy overseas, has long been prohibited. George W Bush reiterated this in Executive Order 13406.

Interesting article.  Transcanada screwed up, but the family stupidly compounded the problem by continuing to use their septic system after is was damaged.   Who in their right mind would continue to use a septic system that wasn't working...to the point where it began backing up into the house and onto the carpet?   Duh.   Better to bring in a contractor immediately to relocate the damaged leach field, save the receipts and then try to gain compensation from Transcanada.  The fact that they KNEW the septic field was going to be destroyed and did nothing but sit and watch...and then continued to use it defies logic.   Definitely an anti-Keystone article for sure, but if this story is their only ammo, they best reload with something else.  However, trying to communicate problems to the huge corporation taking your land by eminent domain is something to think about (and plan for), especially with the Columbia Leach Xpress and the ET Rover coming at us.

Perhaps there was no location to move the leach field to?  According to the article, the Septic was mentioned in the original "negotiations" and the landowners were assured that it wouldn't be a problem.  Have you dealt with a large interstate pipeline coming through your property before?  If not, consider yourself quite lucky.  As for the KXL, I read recently that TransCan is going to build a line across Canada to Nova Scotia so they can sell their oil to foreign markets.  Good.  No need to tear up land here for the sake of Canadian & Pipeline Owner's Profit.

Right.  The US doesn't need jobs right now.  It especially doesn't need high paying construction jobs.  We're doing well without these sort of projects, right?  And that $3,000,000,000 that it will contribute to GDP is not at all something that could be considered a tangible benefit.

Appalachian:    Nope, I have escaped being treated to an interstate pipeline, but I did watch the Rockies Express every day as it steamrolled through Guernsey County....and I'm real glad they chose that location instead of another closer to home!    Some folks welcomed it, some folks didn't.  It takes all kinds.

What happens if the Keystone XL does not proceed and Canada ships its oil East to Nova Scotia for export to Europe or ships its oil West to British Columbia, for export to Asia:

U.S. Gulf Coast refineries are configured to run on the heavy oil that comes out of Mexico (Maya Mud) or out of Venezuela’s Orinoco Tar Belt. Both Mexico’s and Venezuela’s fields are in decline ….. and the loonie left government of Venezuela have committed much of that declining production to their new BFF – China.

U.S. Gulf refineries now need Canadian Crude from Alberta’s Athabasca Tar Sands to replace the loss of Maya Mud and VZ heavy oil.

U.S. Gulf Coast refineries have been working at record high rates, refining foreign oil and exporting valuable product; providing additional jobs for native born Americans and improving America’s balance of payments.

Some of that Alberta’s Athabasca Tar Sand oil will still make it to the Gulf Coast; via rail …. A much more dangerous and polluting (and expensive) means of transport (benefitting Obama’s BFF Warren Buffet’s BNSF railroad). All that oil traveling by oil has tied up the rail system ….. meaning the crops of America’s mid-west farmers are having trouble mading it to market  …. meaning that Wyoming coal is not making it to coal fired utilities that America needs to provide electricity to much of America this Winter.

If you want to hurt America's farmers and increase the cost of electricity this Winter, oppose the Keystone XL pipeline.

Without Keystone XL …. More pollution in America, as oil moves by rail (through American cities), fewer American jobs at refineries, deteriorating balance of payments, China Benefits (if you like China, oppose Keystone XL), if you want higher Gasoline and Diesel prices in America, oppose Keystone XL. If you think that the second richest man in America (Warren Buffet) needs to be a lot richer, oppose Keystone XL. If you do not like Canada and Canadians (you know, the people who buy the products America still produces), oppose Keystone XL. If you want our Government to spend more of your tax dollars on subsidies to support uneconomic Windmills , Solar Farms and biomass projects … oppose Keystone XL If you support one of the various Socialist and Communist organizations that oppose the Keystone XL … then you are amongst your friends.

That Canadian Pipeline company who is attempting to build Keystone XL is traded on the NY Stock Exchange; many of its investors are American citizens and American Pension funds.

If you think that America’s employment rate is too high, you are the kind of person who should oppose Keystone XL.

If you love China and hate Canada, you are the kind of person who should oppose Keystone XL.

If you want to insult all Canadians and hurt them in any way you can, you are the kind of person who should oppose Keystone XL.

Opposing Keystone XL is an excellent example of America shooting itself in the foot (12 gauge, both barrels).

All IMHO,

JS, Another good thought provoking article and I agree with you 100%. Thanks.

Wow.  I never realized that I was a Farmer Hating, Obama BFF, Canuck hating, Commie Marxist, Lefty Pinko, Stalinesque, North Korean and ISIS supporting, Earth destroying, unpatriotic, Solar farm Loving, Warren Buffet BFF, China sympathizing Idiot.  Thanks for clearing that up for me.

Huh....all because I think the Keystone is unnecessary.  Buy into the propaganda all you like.  America will be fine without it.  All those temporary/transit workers can be utilized elsewhere that they are needed.  Railroads don't provide good jobs, I guess?  Canada wants to sell oil to China...a bit of a conundrum as far as if I like China, I hate Canada for selling them hydrocarbons?  But I don't like China....so that means I like Canada, but I hate Canada because they are in cahoots with "the reds"....or should I just hate everyone?

By the way, most Canadians don't particularly like American lifestyle and think we are idiots....but they do like our money.

It appears to me that when you lack facts, you select name calling.

It is true that Energy Transfer, the company constructing the pipeline, is trying to purchase the line rows in acreage.  For what its worth the landman in charge of the section crossing my farm said that he has done two other FERC lines with this company and they did not have to use imminent domain one single time.  True?  I dont really know.  I think Zack is right upon total refusal they will use it but as long as you stand your ground on your demands it'll help out.
