This landman came in and signed some landowners in my area.  I've read his lease and some things just don't sound right.   The following bothers me the most:

Lessor's Covenants.  Lessor hereby covenants that he is seized of an indefeasible fee simple  estate in the land herein before described, together with all the underlying  oil and gas, and that he will forever warrant and defend the leasehold estate hereby demised unto the lessee against the lawful claims and demands of all persons whomsoever, and that the lessee shall have the exclusive, full, free and quiet possession of said described premises for the purposes and during the term herein set forth.  Lessor further agrees that the lessee at its option may pay and discharge, when defaulted, any taxes, mortgages, or other liens existing, levied or assessedon or againstthe above described lands, and in the  discharge of any such mortgage, tax or other lien, any royalty or rentals accruing hereunder.

 

This sounds like much more than a Special Warranty of Title.  Can these gas companies take more than just the oil and gas with a Lease?  What are your thoughts on the above paragaraph?  What is the landowner ACTUALLY signing away?

 

1. Reserve gas = 200,000 cubic feet per year.  Most are 350k and/or a monetary value.

2. No mention of the word "Gross Proceeds" and when asked, he stated XTO wouldn't allow it.

3. $20,000 total for a pad site, includes 7 acres and can take additional acreage for $3k/acre, no limit.

4. Nothing for Workers Comp or Liability Insurance, Umbrella Insurance or Business Auto or Liability Insurance.

5. Nothing stating No Pits, No Compressor or Processing, No Hazardous Materials, No Disposal or Injection Wells.

6.  Conveys all rights to drill and operate for oil and gas in ANY underlying strata....

 

Am I missing something?  The landowners that signed this lease have been involved for almost a year and signed this lease without even having their lawyer review it, and they own near 300 acres!

You started running your mouth about how successful this deal was( see earlier post, but i'm sure you will delete it)when i asked who the deal was with. You really need to get your facts straight, Lensman approached us, we didn't approach them!!!! You have not stated any facts to twist. Please don't reply to me until you get some facts. Thank You.

You make it sound like a group of people ran to Lensman for their representation. They are not from around here, they approached landowners around here. So again you say something like"The group hired Lensman". No, people were solicited to join their group, but you put down all the other people that were soliciting in this area. Take you and all your insults and crawl back under your trailer!!! You are defending lawyers that came in here with one intention, to get a cut of the money paid to landowners around here! Lawyers now there is an upstanding and honest group.........hahaha......HMMMMMMMMMMM!!!!!!!!!!

HMMMM!, How many acres do you have to lease and what township is your acreage located in?

 Why do i have to have an angle or be working for someone?  I happen to think CHK is a horrible Company, looked them up when DPS knocked on my door! What is it with you people, someone questions something and you guys get rude and ignorant, like H BO said if it's such a great deal why so much secrecy? Instead of questioning what my angle is why not just provide where to find out more on this company that you say has plenty of info about? I see you just through in your assets of over 2 billion, how creative! So if Mr. Leeds is correct on their name,and I can guess he is by the way he was attacked on here with threat of legal action, they have all that money but can't buy a phone or get a web site!!!!!!!!!!!HMMMMMMMMM!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

I've been reading your replies and you are nothing but an angry man who changes his opinion almost daily, you act like you have some kind of insight but in reality you have no great info to offer anyone on here, just opinions! I suggest you act like the rest of us who are in this process for the first time and ask questions instead of giving one sided and differing answers!!!!!!!

Yeah.  There were a good number of people ready to jump aboard the Buckeye Mineral Development/ALOV when this was posted and many made calls to BMD/ALOV.  I spoke to them 4 times and was told they would take anything in Belmont.  They even put me on hold and came back on to verify.  Now.....who the heck knows?  The only real offer I've seen with good lease language is from the Lensman Group.  Des still has NO lease, no matter what he's saying at the meetings this week.

Have heard that their offer to the York Twp. group is in the low $4000's and 16-17% gross royalty....not too impressive.  They're pitching that southern Belmont County isn't worth as much because their speculation maps show this area as a 'dry gas' region.  Mark Leeds is currently leasing for Phillips/XTO for $5000 and 19% gross with some decent addendums.  I believe Lensman will lose quite a bit of acreage from their group is this is all true.  According to one group leader, Lensman is supposedly working a backdoor fee with the gas company leasing, which is exactly what they said they weren't going to do.  I'm not sure this is true due to the 'ethics' involved with lawyers......then again, they are lawyers, so who knows.  Their offers should be presented to the group later this week.

You have signed no secrecy clause, but you claim Company has 2 billion in assets, but you try and clean up your statement by saying they have shell companies........Who is it???????? And i copy and paste for those who change thier minds more than a politician in an electection year, and by the looks of the paragraph above, that would be you!!!!!!!! My point is this, we all have opinions and that is fine, but please don't act like the are the hard cold facts, they are not!!!!!!!!! You have changed your mind on here way to much to be considered an accurate source. You say ALOV changed thier mind, but you spouted them up until the truth came out. Again, we need to do our homework on this before we make such firm statements and you obviously did not, landowner groups are run by people who are here to make money on us, they are above noone. You said right above this you reviewed the deal for family, now your saying it wasn't available....Which one is it Sid......You've flip-flopped again........You said the company has 2billion in assets..If you didn't see the lease how do you know the company......What are you saying,you read over the Lensman proposed lease and never saw the final copy(which means you don't know what was really signed)so all of this would be your opinion! Which is fine, but state it as that, not as gospel!!!!!!!!! I will let this go now because it is stupid to continue, all of the statements made on here in favor of the Lensman deal have asterisks and can only be backed up with"Oh we can't disclose that, but trust me, it's a great deal" What a joke!!!!!!!!!!!!!

Wow.  I was asking about an 'angle' because it sounds like you are more than just a landowner.  Are you a landowner in Ohio looking to lease your property?  ALOV misrepresented themselves on the phone a few weeks back to quite a few people when they stated that ANYONE in Belmont County would be accepted in their deal.  That came directly from Mr. Rea's mouth during a telephone conversation.  Their deal sounded great until the actual truth came out.  I received my information on the Lensman deal because I was asked to review the lease for my family's interests.

 

Now the second when you said it wasn't it wasn't available to you

Those were obviously rumors that were floating around before the actual deal was presented......and those rumors were started by a group leader mentioned quite often on this site.  As I've said before, I'm not in the Lensman Group, so the actual deal was not available.

This is interesting , I'f Lensman's deal is the bomb why not share it and bring in a lot more landowners ?

I meet with them and was less than impressed , when I asked them about everyones land  being included   meaning all landowners he said well that might not happen and could not promise that . That didn't work for me , to many loose ends .

My dealing with O-G companies is that they are all about themselves and to join forces with a law firm is in my opinion is not warm and fuzzy . I hope for your sake's I'm wrong .

A bit of advice if it's not to late have them change the arbitration clause that you have a option to a trial for breeches of your lease  .This will really help everyone if they have any problems . Trust me they hide behind the vail of arbitration because it keeps them out of the lime light and there is no punitive damages recovery  or recovery for legal fee's .

Don't let anyone tell you that you can't go up against the big boy's with the trial clause that is a bunch of BS .

I tell you all this to help you  .
