Has anyone in the northern Mercer County area (Kennard/Osgood) been approached by a land man from Midwest Land Services, representing D&L Energy?  I have an existing 10 year old lease with one well and they left me, on my porch, an amendment to unitize my 23 acres.  It doesn't have any other changes to the lease other than changing the size of the pooling and unitization to 1,280 acres.  I called the guy who left his card and asked him "what's in it for me?"  My question is, do I have any leverage to get a higher royalty percentage or up front money and should I see an O&G attorney before signing anything.  Anybody else have a situation similar to this?

CL...dealings are oil and gas related but do not involve leasing.

Ahh D and L!!!! Due to prior experience With D and L I would want the money in my account before I would ever consider .....

My guess is that D&L has a deal on the table to sell their leaseholds in Hempfield T'ship, West Salem and other townships surrounding the Greenville area to a player already in the area, but only if those leases can be modified to 1280A  production units. It only takes a 10 minute drive around Hempfield alone to see the size of the properties they hold. Someone with a D&L lease needs to step up and get other owners of D&L leased properties together. Put an ad in the Record Argus and set up a time and place to meet and discuss this issue. Don't be in a rush to give what's under you, if anything, away. There is nothing wrong in demanding fair compensation in exchange for amending your leases. I don't think D&L is doing this to make a few bucks, but more like millions.

Lease modifications -

The one thing it would do is bring you to the 12.5% the state minimum.

Sounds like you are in an old HBP or storage field

I would not agree to the size of the pooling/unit - 640 max - they are just trying to get this cleaned up before selling - DL is not a deep driller - keep your eye out for mineral buyers next Mercer will be a hot bed - question is when will anyone start drilling deep in that HBP.

Quick question for those who have been asked to sign an amendment to their D&L lease:

 - Does your proposed ammendment contain laguage allowing pipelines and seismic testing as a part of your revised lease?

 - Does your proposed amendment adjust the unit size to 640 acres or 1280 acres?

We have a meeting wth ur O&G attorney today.  He has reviewed the ammendment and our situation and will provide some direction for us to consider.  Will share what I can for those here who are intrested or impacted.
