Public speaks out on fracking in Middlesex

"Drilling opponents have said they will appeal the zoning hearing board's decision in court if it goes against them. The township has said it will do the same if it loses.

An appeal could last years and help define the extent to which municipalities in Pennsylvania are allowed to oversee and regulate hydraulic fracturing, supporters and opponents of the ordinance say"

Essentialy any further activity in Middlesex is dead and done for quite a while. This will be appealed as far as it can go.

I think we need to counter sue the 4 residents who started all this for damages in holding up the fracking progress, and include a bill for the township legal fees.  Seriously....

According to the Butler Buzzard the hearing board will make a decision April 29th.

The last hearing was yesterday.Final arguments and such.

Probably does not matter the decision. Both sides will likely appeal and from what I read that could take 2-3 years for a final decision.

For all intents and purposes any further drilling in Middlesex is kaput.

The Middlesex zoning hearing board has delayed its vote on a controversial fracking ordinance until May 27.

The vote had been scheduled for April 29, but a board member will be traveling then.

The zoning board heard many hours of testimony in a challenge to the township supervisors' August approval of an ordinance allowing drilling in most of the township.

Last month the last of nine hearings on the issue drew a crowd of more than 300 people.

The zoning board is scheduled to vote during a meeting that begins at 6 p.m. at the township's fire hall.

"Rex Energy will move forward with the Geyer well site, said Michael Endler, Rex's regional vice president based in Cranberry."

I wonder if they can still try to hold this up with more legal maneuvering while the appeal is being heard?

School will be out shortly, so the truck traffic and such should be less of  a problem. They could easily drill and frac before school starts again in the fall.

I am not sure what the water situation is over there, may have access to "city water". If so, cuts a ton of truck traffic out.

I believe the access road and the pad do not need too much more work.

Unless they can legally stop it somehow, Rex would be wise to get er done. 

Last day of school is June 5th.   I'm sure what I mentioned to you privately FairMktValue will be happening once the appeal process begins.  Do not want to mention this openly due to some eyes and ears on this site are anti-drilling.   This could get even more interesting.  Rex better get in gear.  I will have to drive by after work to see if there is any activity.
