Does anyone have any personal experience of lease getting renewed or not renewed? In eastern Carroll county Ohio and lease is up in dec. roughly 200 acres. Thanks!

You would think they would be contacting you soon with some kind of crappy lease. If not, they may just renew it as according to your lease, if that is their option. And if so, they may not contact you, just send a check  to go another 5 years. OR, they may just let it expire, then have a landman come by in a few weeks with a new, not so landowner freindly lease. Or , you could just call them?

CHK is not renewing leases in western Carroll rose twp our lease is just north of atwood lake 240 acres .......it  was involved in a  permit that was issued 4 years ago but they allowed our lease  to expirer......I guess that permit is void now and the pad they built will left to go back to nature........seems like they are pretty  broke that they have spent so much to let it all go to waste''''''t maybe that area will be bought by a good production company at the fire sale  when the feds indict the corporation like Aubrey was and closes there doors.................. by not paying people what they are suppose to that is mail fraud...........and even after Aubrey hit the bricks criminal activity  in the leasing end continued......actually Aubrey was the first to get caught.........also all the acreage around us is HBP  and held by Enervest from Clinton wells

The April 2011 ALOV Leases weren't renewed and were supposed to be released by the Quarter in which you ask for a release.

Oct 31st will be the end of the Primary Term for the November 2011 ALOV signings with THAT COMPANY so anyone who doesn't want to be stolen from by being under production with the company not mentioned above should call and ask for a Release.

Those held by production, typically 1/2 acres or acreage captured by one of the <640 acre Units, need to pull acreage using the Pugh Clause.

Chesapeake owns the pipelines and processing plants, so they could sell off their lease holdings, including your lease that is no longer valid, if not Released, and still make a fortune as they are in PA by overcharging for the use of their facilities that Landowners always pay for with the Royalties that were stolen from us. 

Let's not forget those in power who have invested in our infrastructure by way of Master Limited Partnerships and have tried to make our loss their gain. I'm sure THAT COMPANY didn't actually share the money that was stolen. The only people who don't get stolen from are those running this National Scam, and you can count them on one hand and 3 fingers from the other hand.

Where and when? 

Had three ALOV leases with Chesapeake in Jefferson County, Ohio.  They were to be renewed in April but were not.  I called Chesapeake and they said they were cancelling all. I did not believe them and started to proceed to go through the process to have the leases forfeited.  As it turned out they issued a release on the two properties located in Knox Township but no release was issued for the Island Creek Township property.  The Island Creek property is where they bored 18 holes for seismic testing last February or March.  I believe that Chesapeake wanted to keep that lease open by just not cancelling it and hoping I would do nothing. We followed the Ohio Revised Code for forfeiture and I filed the final forfeiture documents at the courthouse earlier this week.  I think that until you do this the property remains subject to Chesapeake's lease unless they actually file to cancel the lease at the courthouse.  Frankly, I do not want to have any more dealings with Chesapeake because of their past history and the lawsuits filed against them for non payment of royalties. Good riddance!

     If you signed a Right of Way Contract with one of 3 companies, you will have to deal with Chesapeake one more time.

I saw where all ROW contracts were transferred to Cardinal Gas Services and have since learned that Cardinal is Williams Partners, is Chesapeake. 

What few landowners know for now is that those who signed have lost their Right of Way to Cardinal/Chesapeake. The Ohio Revised Code doesn't allow what has been done, since taking a landowner ROW when asking to sign for one or two pipelines is considered using Fraud to get a landowners signature.

This needs to be a class action suit in all 3 states where this ROW activity has taken place.

I think that as a legal matter the lease is forfeited at the expiration date regardless, the other part is that you will need to pursue forcing them to release the acreage if they don't do so willingly.

In other words, the forfeiture of the lease is based on lease terms, not the actual act of Chesapeake or any other producer filing the correct paperwork.

You may not be able to get a different company to sign and pay you without the release. They may be trying to buy some time, frustrating you into signing an extension by delaying filing the release but legally I don't think they can do much more than that after the expiration.

Please keep us posted, and if there is anyone whose legal opinion is more informed than mine and who differs in that opinion please correct me if I am wrong.

Don't know if this will help as I am in Pa, Tioga County...My lease was up in June of this year, I waited til August to request a Surrender of Lease. I got an e-mail back the same day, asking me to wait "several business days" so an analyst could look over my request. Didn't hear anything, even after a second e-mail. About 5 weeks later I received a phone call saying they were interested in having a sit-down to discuss a new lease...that's scheduled for next week...we'll see what happens...I only have a few acres but there is a good bit of activity around me right now...If you don't hear anything, I recommend contacting them so they don't just hold onto the lease and leave you hanging... Theresa
