Greetings everyone, I am new to this forum and am hoping that someone can point me in the right direction. I am desperately looking for resources and advice about leasing provisions that add extra protection for my well. I have not leased my property yet and am only interested in doing so if I can get an extra layer of protection for my property. Any assistance with this is very appreciated.

Just arrived a train of trucks to the property across the street.  This site has made me aware that there will be two wells drilled on my neighbor's property.  Seven (7) unmarked trucks with a few small trucks turned around and left since if they stayed they would have closed the road.  One truck is in one lane.  QUESTION: CAN THEY DRILL UNDER MY PROPERTY WITHOUT A LEASE?????   Patricia

Jane,

If everyone really can't stand each other already, then a partition action might be in order so everyone is forced sell out or one or more people can buy the others out at FMV - which obviously is going to be significantly higher these days.

DISCLAIMER (i.e., CYA – I suppose CMA): Attorney-Client Privilege/Confidentiality is not established and does not apply to either questions or responses. Hence, do not disclose any confidential information (which would be really stupid anyway since thousands of people are reading this stuff). Responses are not to be taken as legal advice. Only one piece of legal advice is being given: HIRE YOUR OWN ATTORNEY TO HANDLE YOUR OWN SET OF FACTS AND DISTINCTIVE LEASE TERMS AND ISSUES! A brief recital of facts and issues in a discussion forum can NEVER convey all of the facts in each idiosyncratic case. Likewise, a brief response to those incomplete set of facts and issues in a discussion forum can NEVER convey a functional analysis of your unique situation, and, as such, cannot be relied upon by you as legal advice for your unique situation. Believe me, fact situations are about as similar as fingerprints. Moreover, all of my responses are talking about Pennsylvania law because that is where I am licensed. That means if you are from outside of Pennsylvania you can go ahead and throw everything I said right out the window (darn, I was trying to make it through this without resorting to a cliché . . . or a French word). Thus, while my responses might be free, they are not legal advice. Do not be so stupid as to try to save $1,000.00 whenever you have the opportunity to make $100,000.00. So take it from Warren Buffett – “Price is what you pay. Value is what you get.” If you do not pay the price you will really pay the price. I hope I avoided ticking you off, but hey, wasn’t that a great disclaimer!

Mike,
I am part of a family farm in Middlesex Twp., Butler Co. Would you mind telling me who you leased with and the terms? I have been trying to get my 5 siblings to sign a lease with no success. (Reasons why we can't seem to agree to sign are too long & ugly to go into.) Our last offer was $3,000/acre & 18% royalty from Rex. We had a simlar offer initially from Williams. Still hoping to get consensus to sign with someone but we are out of leasing offers right now and I am looking for other companies.

Mike,good to hear from you.
I have property in Middle Lancaster Twp,with a lease that was signed in 2006,due to expire in 2011. And I have property in West Deer Twp,no lease.
It sounds like you are about in the middle area of my two properties. Do you know if there is a Land Owners Group in our area? Do you know of any meetings in our area that maybe coming up that I could attend?

Hello to All

I just joined the group and I'm excited to be here. Is there anyone in the Group from the Seneca Valley School District area ? I went to Seneca and still have property in the area. We have a gas lease on the property which is due to expire in 2011. Would love to connect with others in this area,to stay informed on the latest news on how things are going with the Marcellus Shale gas-leasing.

I'm looking for George Karazsia the landman in your area. Anyone here know him? He made a great impression in my area, (Tioga County), and I'd like to throw a favor his way if I can find him
