My 5 year lease in archer township is due to expire this September.  Before I contact the company I was wondering if anyone in our area has been renewed and at what terms.  Thanks ahead of time for any info you are able to share.

When the o/g companies started declaring abandoned interests en masse , e.g. hundreds of properties in one fell swoop in the fall of 2011 alone, I have doubts that they ever advertised or tried to find the families of original owners.  Our family had a sub contractor for o/g who was able to track our family down, albeit after the fact.  So what kind of an effort was made by the o/g company?  Not a very good one apparently.    Another aspect is that this isn't the 1940's or 1950's and so many families may have mineral rights but no longer live in the Harrison/Belmont area.  Consequently, they may never be notified or even have a clue that they need to validate their holdings.

Here's the conclusion

CONCLUSION
{¶ 37} "We hold that a mineral-interest holder’s claim to preserve filed
pursuant to R.C. 5301.56(H)(1)(a) is sufficient to preclude the mineral interests
from being deemed abandoned if filed within 60 days after notice of the surface
owner’s intent to declare those interests abandoned. We therefore affirm the
judgment of the court of appeals on this issue alone, and the appellants are
precluded from declaring the mineral interests abandoned under the Dormant
Mineral Act."

My reading is that owners of severed mineral rights don't lose them automatically after 20 years of dormancy but have to respond within 60 days of the surface owner's declaration of their intention to declare them abandoned. Mineral rights owners need to stay alert to these notices or better yet, affirm their continued ownership by having the county auditor create a separate tax parcel for the mineral rights.
